La relevancia del consentimiento prestado por la mujer en los delitos sexuales

Abstract

El consentimiento en los delitos sexuales es una figura que cada vez cobra mas relevancia, significando su falta o vicio, la comisión del delito. Dos iniciativas legislativas, intentan, de la mano, guiar una reforma del Código Penal con la finalidad de adaptarse al Convenio de Estambul, cuyo objetivo es darle esa importancia al consentimiento. Existen diversas formas de otorgar el mismo, ya que, en este tipo de relaciones personales, rara vez se firmará un documento para permitir proceder a las conductas íntimas. Aún así, se pueden presentar circunstancias en la víctima que vicien o invaliden su consentimiento, por lo que es muy importante tenerlas en cuenta. Lo mismo sucede con el consentimiento otorgado por un menor de 16 años a un adulto, será inválido (habiendo una excepción a esa regla). Es un acierto echar la vista atrás para observar la injusta regulación sobre abusos en la pareja que se tenía hace unos años, totalmente diferente a la actual, ya que el delito es considerado de igual manera cometido fuera o dentro de la relación, sin que esto sea un posible atenuante. Sin dejar de lado, por último, la cuestión de los sujetos que intervienen en el delito y su posible actuación individual o colectiva, diferenciando las consecuencias de las posibles actuaciones.

Consent in sexual crimes is a figure that is becoming more and more relevant, meaning its lack or vice, the commission of the crime. Two legislative initiatives are attempting, leading by hand, to guide a reform of the Criminal Code in order to adapt it to the Istanbul Convention, the aim of which is to give that importance to consent. There are different ways of granting consent, as, in this type of personal relationship, a document will rarely be signed to allow intimate behaviour to proceed. Even so, circumstances may arise in the victim that vitiate or invalidate her consent, so it is very important to take them into account; the same happens to the consent given by a minor under 16 years old to an adult, it is invalid (there is an exception to this general rule of invalidity). It is a good idea to look back at the unjust regulation on abuse in the couple a few years ago, which is totally different from the current one, since the crime is considered to have been committed in the same way outside or inside the relationship, without this being a possible extenuating circumstance. Without leaving aside, finally, the question of the subjects that take part in the crime and their possible individual or collective action, differentiating the consequences of the possible actions.
