dc.description.abstract | Debido a los recientes fenómenos sociales, en especial, la guerra en Ucrania, la gestación subrogada y su regulación han vuelto a ser objeto de interés, lo que provoca que sea relevante analizar las circunstancias en las que quedan sumidas las mujeres que prestan su consentimiento para ser gestantes. En este sentido, se tratarán las circunstancias que en un primer momento se establecen en los contratos tipo de las agencias de gestación subrogada que operan vía online en España y demás países del mundo, comparándolas con contratos reales que han salido a la luz entre los padres de intención y la madre gestante, así como las consecuencias que provocan este tipo de contratos en las madres y los bebés fruto de esta relación contractual tanto en su vertiente más altruista como como en su vertiente más liberal y capitalista, comparando las cláusulas contenidas en estos acuerdos con la regulación estatal sobre cláusulas abusivas en contratos con consumidores y usuarios, con el fin de averiguar si las cláusulas de los contratos de gestación subrogada pueden ser consideradas cláusulas abusivas. | es |
dc.description.abstract | Due to recent social phenomena, especially the war in Ukraine, surrogacy and its regulation has again become an object of interest, which makes it relevant to analyze the circumstances in which women who consent to be pregnant are left. In this sense, I will address the circumstances that are initially established in the standard contracts of surrogate agencies operating online in Spain and other countries of the world, comparing them to real contracts that have come to light between the parents of intention and the pregnant mother, as well as the consequences of such contracts on mothers and babies resulting from this contractual relationship both in its most altruistic and its most liberal and capitalist aspects. In this sense, the clauses contained in these agreements will be compared to the state regulation on unfair terms in contracts with consumers and users, in order to discover if the formers could be considered unfair terms. | en |
