AB The present work focuses on the study of disinheritance in both common law andBasque law due to the fact that a recent Law 5/2015 came into force that repealedall the regulations that had previously existed in the different historical territoriesincluded in the Autonomous Community of the Basque Country.Well, first, an analysis of the disinheritance in common law, as well as the legallyestablished causes for it and other important aspects on the subject, such asrequirements, effects, consequences ... Secondly, an observation is made of thenew aspects introduced by Law 5/2015, on Basque Civil Law. These new aspectsare the successions affected by the new law of Basque civil law, weakening of thelegitimate and the separation, improvement of the position of the widowed spouseor surviving couple among others.Therefore, we will make a brief description of both systems highlighting the mostrelevant aspects regarding the disinheritance, both of the common law and theBasque provincial law and the modifications of the new Law.
