AB This work is based on the analysis of the legal guardianship or child custody,with a small reference to its regulation in the past, before the present text of theCivil Code was applied. The way courts have ruled, and some significant judicialdecisions are also analyzed, as well as the most common problems that appear ona daily basis.At the same time, the principles that rule child custody will be studied, includingquotes of court rulings of the Supreme Court and the Constitutional Court relatedto child guardianship in general and joint custody in particular and also, doctrinalpositions and considerations of joint custody with the aim of finding the mostbeneficial model for the children interest.Specifically, the main issues faced by our courts at the time of attributing the useof the family home or alimony will be exposed.Finally, an examination of the situation of COVID-19 and the agreements takenby the different Family Courts with regard to what was arranged by the GeneralCouncil of the Judiciary will take place.
