AB This work addresses the existing problems in the criminal process regardingthe burden of proof´s norms, starting from some general notions, andanalyzing each of the cases in which the general norm regarding the burdenof proof seems to be infringed: its membership to the accusation.In this sense, the relationship between the burden of proof and presumptionof innocence is brought up, starting from a conceptual analysis, where therelationship between both concepts is studied, and the possible violation ofthe presumption of innocence is explained in the assumptions where theburden of proof is distributed.Therefore, the criterion of the jurisprudence on the proof of the favorablefacts to the defense, the existence of presumptions-legal and de facto- in ourcriminal procedural law is analyzed. And, finally, the possible legalconsequences of the approval of the new “Anteproyecto de Ley Orgánicade Garantía Integral de la Libertad Sexual”.
