A1 Arrate Partenheimer, Ariadna Valeska A2 Grado En Derecho K1 Responsabilidad patrimonial K1 Lex artis K1 Administración K1 Fuerza mayor K1 Pérdida de oportunidad K1 Indemnización K1 Daño moral K1 Daño corporal AB In the present work we will study the patrimonial responsibility of thepublic administration, regulated in the Spanish Constitution, and developedby the current Law 39/2015, specifically when we are faced with sanitaryerrors, differentiating the type of damage produced, which may be moral orcorporal.In order for the patrimonial responsibility of the administration toarise, and also to display all the effects established by law, a series ofassumptions must be met, such as the normal or abnormal functioning ofthe public administration, the production of a compensable damage, theexistence of a causal link and absence of force majeure or cause ofunpredictability with the knowledge of science at that time.Of special importance, in order to determine responsibility, there arecertain figures such as the doctrine of loss of opportunity, the correct use ofthe lex artis and the presence of informed consent when carrying out amedical intervention.Lastly, once the responsibility has been determined, we move on tothe compensation procedure for the damage caused by the normal orabnormal functioning of the public administration, and the due request mustbe made so that the appropriate procedure can be initiated. To conclude theprocedure, two different modes of termination may be given: early orordinary.
