AB In the last decade, Poland and Hungary have passed legislation and promoted public policieson LGBTI people contrary to the principle of non-discrimination and other European valuesset out in Article 2 of the Treaty on European Union. The aim of this Bachelor Thesis is toanalyse the conceptual scope and regulation of fundamental rights and the Rule of Law in theEuropean Union, as well as the mechanisms to safeguard them, such as Article 7 TEU, Article258 TFEU or the recently approved financial conditionality mechanism. Finally, theapplication and effectiveness of these mechanisms in cases of discrimination against LGBTIpeople will be assessed, in particular three: infringement procedures, budget conditionalitymechanism and the role of the CJEU in different cases brought before the EU's high court.
