Ley 15/2005, de 8 de julio de modificación del Código Civil y la LEC: guardia y custodia compartida

Abstract

Ley 15/2005, 8 de julio, de modificación del Código Civil, ha modificado el sistema legal de guarda y custodia diseñado en el Código Civil, al introducir el modelo de la guarda y custodia compartida, con la finalidad de procurar la mejor realización del beneficio e interés del menor, así como el de ambos progenitores, en la idea de que pese a la crisis familiar, la nueva situación les exige, incluso, un mayor grado de diligencia y compromiso en el ejercicio de la patria potestad.

Law 15/2005 of the 8th of July,modification of the Civil Code,has modified the legal system of guard and Custody designed in the Civil Code,by introducing the pattern of guard and shared custody, with the finality to obtain better benefits for the minor,and also for both parents,with the idea,despite going through a familiar crisis,including the new situation needs a mayor degree of care and compromise in the exercise of the legal right to keep and look after a child.
