Obligación de alimentos a hijos mayores de edad: aspectos controvertidos

Abstract

La figura jurídica de la obligación de alimentos a los hijos mayores de edad que encuentra su regulación básica desde el artículo 39.3 Constitución Española hasta los artículos 142 y siguientes del código civil. Dicha figura a día de hoy no es una cuestión pacifica en los tribunales y hay que analizarla en su conjunto, pasando por la regulación legal, por su interpretación doctrinal y jurisprudencial. Además hay que añadir dos cuestiones que han marcado el desarrollo actual de la configuración de la obligación de alimentos para entender hoy en día como es la perspectiva económica y la social, que han marcado el desarrollo de la actual forma de entender de cara a la aplicación de este concepto jurídico por parte de los tribunales y que en estos últimos años han tenido varios pronunciamientos diferentes teniendo en cuenta los casos en concreto, por lo tanto aplicando en su conjunto la regulación legal, la doctrina, la jurisprudencia, la situación económica y social actual tendríamos la obligación de alimentos a los hijos mayores actual.

The legal figure of the obligation of maintenance to the sons of legal age that finds it is basic regulation from article 39.3 Spanish Constitution up to articles 142 and following of the civil code. This figure today is not a peaceful issue in the courts and must be analyzed as a whole, going through legal regulation, for its doctrinal and jurisprudential interpretation. We must also add two issues that have marked the current development of the food obligation configuration to understand today how is the economic and social perspective that have marked the development of the current way of understanding for the application of this legal concept on the part of the courts and that in recent years have had several different pronouncements taking into account the specific cases therefore applying as a whole the legal regulation, doctrine, jurisprudence, the current economic and social situation we would have the obligation of food to the sons of legal age.
