Las normas que regulan el contrato de trabajo internacional: competencia judicial de los tribunales españoles y derecho laboral aplicable.

Abstract

This project has as objective the analyse and development of legal regulation of international private relationships, particularly the international labour contract, regulated by International Private Spanish Law. This rules often come from communitarian legislator, thus, on one side the Brussels I Bis Regulation (No 1215/2012) which rules determinate the International Judicial Competence, in other words, the rights state tribunals who has the competence to know and solve the litigation, and, on the other side, the Rome I Regulation (No 593/2008) about the choice of law, which determinate what state labour law between the ones liked to the litigation, it must solve the lawsuit about International labour engagement.

El presente trabajo tiene por objeto el análisis y desarrollo de la regulación jurídica de las relaciones privadas internacionales, especialmente el contrato de trabajo internacional, regulado por normas de Derecho Internacional Privado español. Estas normas principalmente provienen del legislador comunitario, así, por un lado, el Reglamento 1215/2012 Bruselas I Bis, cuyas normas determinan la competencia judicial internacional, esto es los concretos tribunales estatales competentes para conocer y resolver el litigio; y, por otra parte, el Reglamento 593/2008 Roma I sobre ley aplicable, que se encarga de determinar qué derecho laboral estatal, de entre los vinculados al supuesto, debe resolver el concreto litigio en materia de contratación laboral internacional.
