Ocupación, hallazgo y tesoro

Abstract

Los artículos 610 a 617 del CC regulan un modo de adquirir la propiedad aludido ya en el art. 609 del mismo texto legal: la ocupación. Además, ordenan también el hallazgo y el tesoro. En este trabajo se estudian los antecedentes históricos de los distintos preceptos contenidos en el título I, libro III del Código civil, se analizan las principales cuestiones que se ha planteado nuestra doctrina y se examina la normativa autonómica que se ha ido dictando en materias relacionadas con la cuestión que nos ocupa (caza, pesca y patrimonio histórico, fundamentalmente).

Articles 610 to 617 of the Spanish Civil Code rule a way of acquiring ownership: occupation. They also establish some rules about discovery and treasure. In this work we study the historical background of the articles included in Title I, Book III of the Spanish Civil Code, we analyse the most important issues that have been addressed by Spanish authors and we pay our attention to the different regional laws that have been enacted in topics related to occupation (especially, regional laws on hunting, fishing and historical and cultural goods).
