La evolución de la figura jurídica de la mujer en el derecho matrimonial

Abstract

El tema del que va a versar mi investigación es sobre la figura jurídica de la mujer en el derecho matrimonial y su evolución histórica hasta llegar a la actualidad. Al respecto, el derecho matrimonial ha sido objeto de continuos cambios y fluctuaciones a lo largo del tiempo, y el tratamiento jurídico de la mujer ha variado de diferentes formas dependiendo de la etapa histórica, dejando la igualdad de trato entre hombre y mujer en el derecho matrimonial, como un suceso lento y que solo se vuelve una realidad con la Constitución de 1978. Por ello, es necesario estudiar los diferentes ordenamientos jurídicos que no han sucedido hasta llegar a la actualidad, para comprender de forma mas concisa la evolución del derecho matrimonial actual y el tratamiento jurídico de la mujer en el mismo.

The subject of my research will be about the legal status of women in matrimonial law and its historical evolution until today. In this regard, matrimonial law has been subject to continuous changes and fluctuations over time, and the legal treatment of women has varied in different ways affected from the historical stage, leaving equal treatment between men and women in the law. marriage, as a slow success and that only becomes a reality with the 1978 Constitution. Therefore, it is necessary to study the different legal systems that have not happened until now, to understand the most concise way the evolution of matrimonial law current and legal treatment of women in it.
