Las particularidades de la instrucción en el proceso penal de menores

Abstract

In the present work we have tried to show a little more what the criminal process of minors is, since it is a process that has not been sufficiently treated in the last years, therefore, we have tried to give a little more light on this process. We have learned more about the fundamental pillars of the process and, in particular, we have learned more about the institution of the MF, which is responsible for carrying out a phase of such importance as the investigation, which we cannot forget is the phase aimed at clarifying the facts punishable by law. Why has it been decided to work on the instruction phase in this procedure? The answer is simple, because in the criminal proceedings of minors the investigation phase is very important, as a result of the principle of opportunity, since in the investigation phase, just as the file can be opened, if certain circumstances occur, it can be filed, and as a result of the filing, a complaint cannot be filed again on the same matter, except for the specifications set out in the CIRC 1/2000 of the General State Prosecutor's Office

En el presente trabajo se ha intentado mostrar un poco más lo que es el proceso penal de menores, ya que es un proceso que no ha sido lo suficientemente tratado en los últimos años, por lo tanto, se ha intentado dar algo más de luz sobre dicho proceso. Se han conocido más de cerca los pilares fundamentales del proceso y, en concreto, se ha conocido algo más sobre la institución del MF, la cual es la encargada de llevar a cabo una fase de tanta trascendencia como es la instrucción, que no podemos olvidar que es la fase tendente al esclarecimiento de los hechos punibles indiciariamente. ¿Por qué se ha decidido trabajar sobre la fase instructora en este procedimiento? La respuesta es sencilla, porque en el proceso penal de menores la fase instructora es muy importante, fruto del principio de oportunidad, puesto que en la fase instructora, igual que se puede abrir el expediente, si se producen determinadas circunstancias, se puede archivar el mismo, y como resultado del archivo, no se podrá interponer de nuevo una denuncia sobre el mismo asunto, salvo las especificaciones que nos viene a exponer la CIRC 1/2000 de la Fiscalía General del Estado
