2020Abstract
In the present project, we will talk about the issue of international child-abduction, as
known as "legal kidnapping"; a currently and controversial sensitive issue that has become
more pronounced over time. Also, we will analyze the concept of the supirior interest of the
minor, which acts as a guiding principle for the provisions adopted in the regime for the
protection of them, because of in these cases it is what really must to be taken into account after
the breakup of a relationship between the parents.
The States are working to improve the international instruments able to solve the illicit
transfers that occur, also regulating that in some cases the return of the minor never happen, but
there are many legal loopphole and interpretative discrepancies. There are some legal texts that
are more relevant, but at a global level, the most important one is the Haya Convention of
October 25th, 1980. Similarly, in Spain it is reflected the uniformity lack of judicial decisions,
but there are some advances by our Courts. En el presente trabajo se abordará el tema de la sustracción internacional de menores o
legal kidnapping, asunto actualmente muy controvertido y delicado que se ha acentuado con el
tiempo. Además se analiza el concepto de interés superior del menor, que actúa como principio
orientador de las disposiciones adoptadas en el régimen de protección de menores, pues en estos
casos es lo que hay que tener en cuenta tras la disolución de una relación entre dos progenitores.
Los Estados trabajan en la mejora de los instrumentos internacionales disponibles
capaces de resolver los traslados ilícitos que se producen, así pues también regulan que en ciertos
supuestos no se lleve a cabo la restitución del menor, pero son muchas las lagunas y
discrepancias interpretativas. Algunos textos legales gozan de mayor relevancia, pero a nivel
global, destaca como disposición estrella el Convenio de la Haya, de 25 de octubre de 1980. De
igual modo, en España se plasma la falta de uniformidad de las decisiones judiciales, pero son
visibles avances interpretativos por parte de los Tribunales.
