Los Juicios de Núremberg y su incidencia en el Derecho Internacional Penal

Abstract

El presidente del Tribunal, y representante en él mismo del Reino Unido, Lord Geoffrey Lawrence, iniciaba la sesión del 20 de noviembre de 1945 con la lectura de una declaració n introductoria en la que exponı́a solemnemente: “asistimos a la apertura de un proceso sin precedentes en la historia de la humanidad, y que reviste una importancia inmensa a los ojos del mundo entero”. De esta cita podrı́amos extraer los dos objetos ú ltimos de este trabajo: de un lado, contextualizar y narrar desde un prisma histórico-jurı́dico las dificultades técnicas, jurı́dicas y polı́ticas a las que se enfrentaron quienes crearon el Tribunal y dieron cauce a un proceso, tal y como remarcaba el propio Juez Lawrence, sin precedentes en la historia de la humanidad; y por otra parte, describir la relevancia que, no solo tuvo a ojos del mundo entero en el momento de su celebración, sino que ha tenido y tiene en la configuración actual del Derecho Internacional Penal que hoy dı́a conocemos.

The United Kingdoms court president and its representative, Lord Geoffrey Lawrence, began the session on November 20, 1945 with the reading of an introductory statement in which he solemnly stated: “we are attending the opening of an unprecedented process in the history of humanity, which is of immense importance in the eyes of the entire world”. From this quote we can detect the last two objects of this essay: on one hand, we can contextualize and narrate, all from a historical-legal perspective; the technical, legal and political difficulties faced by those who created the court and detected a process, as the judge Lawrence himself emphasized, unprecedented in the history of mankind. On the other hand, we can describe the relevance of the event, that caught everyones attention at the time of its celebration, and how it had and still has the current configuration of International Criminal Law as we know it today.
