El maltrato psicológico como nueva causa de desheredación

Abstract

En este trabajo se intentará reflejar cómo los cambios sociales afectan al mundo jurídico, y como muchas veces la jurisprudencia es la encargada de amoldar las normas ya preexistentes para que su aplicación se ajuste a la nueva realidad. En este caso, un nuevo tipo de maltrato se abre paso entre los miembros de la familia, dando la oportunidad a los padres de dejar sin herencia a sus hijos, cuando estos muestren una serie de comportamientos, ahora castigados por el Juez. Habrá un acercamiento a los Derechos Forales, para poder concluir si realmente el maltrato psicológico es un castigo, o un primer paso hacia la libertad de testar.

In this essay, an attempt will be made to reflect how social chances affect the legal world and how the jurisprudence is in charge many times the one to adapt the already existing rules so that its application is adjusted to the new reality. In this case, a new type of abuse breaks through among the family members, confering parents the opportunity to leave their children without inheritance, when they show a series of behaviours, punished now by the judge. There will be an approach to the Provincial Laws (Statutory Rights) that will make posible to conclude whether psychological abuse is really a punishment, or definetely the first step towards the freedom to make a will.
