El cambio de nombre y sexo en el registro civil y la disforia de género

Abstract

El presente trabajo tratará la situación de las personas con disforia de género que solicitan el cambio de nombre en el Registro Civil, lo que, a su vez, trae consigo el cambio de la mención registral del sexo, con especial mención a la situación de los menores y a cómo ha prevalecido la capacidad natural de éstos respecto a la decisión sobre sus derechos personalísimos. En particular, analizaremos los dos requisitos sine qua non para la solicitud de cambio: ser mayor de edad y tratamientos médicos en los 2 años previos. Veremos cómo la DGRN y la jurisprudencia del TC ha solventado los recursos que han planteado los particulares respecto a estos requisitos. También se hará una pequeña referencia a la reforma de la Ley del Registro Civil de 1957, además de un análisis de la Ley 3/2007 de 15 de marzo, reguladora de la rectificación registral de la mención relativa al sexo de las personas. Y, por último, se repasará la jurisprudencia del Tribunal Europeo de Derechos Humanos, así como las recomendaciones que ha hecho el Parlamento Europeo respecto al cambio de nombre y sexo registral.

This document focuses on the situation of individuals with gender dysphoria who request a change of name at the Civil Registry, which leads to a change in the gender listing, with special mention of the situation of underage persons and how their natural condition has prevailed with respect to deciding on their very personal rights. In particular, we will analyse the two sine qua non requirements for the change request: to be full aged and to have received medical treatment in the previous 2 years. We will see how the DGRN (General Department of Register and Notaries) and the jurisprudence of the TC (Constitutional Court) have resolved the appeals that individuals have made regarding these requirements. A brief reference will also be made to the reform of the 1957 Civil Registry Act, in addition to an analysis of Act 3/2007 of 15 March, which regulates the rectification of the entry in the register relating to the sex of persons. Finally, the jurisprudence of the European Court of Human Rights will be reviewed, as well as the recommendations made by the European Parliament with respect to the change of name and sex in the registry.
