Un intento de aproximación al concepto de estado de alarma y su utilización durante la pandemia COVID-19

Abstract

El principal motivo por el que escogí este tema fue en primer lugar, porque es un tema de actualidad, y, en segundo lugar, porque en mi caso ha sido un acontecimiento único e histórico para la humanidad, que me ha tocado vivir, debido al gran impacto que ha supuesto para la población mundial la llegada de esta pandemia tanto a nivel económico, como sanitaria y social. Una vez escogido el tema, la metodología que he seguido para su desarrollo ha sido, principalmente en base a artículos de opinión de prensa y artículos académicos, así como informarme a través de las noticias a diario. De acuerdo a las conclusiones obtenidas, deduzco que continuará siendo motivo de discusión política, académica y ciudadana, dado el alcance que sobre nuestros derechos ha tenido, y sobre la toma de decisiones formalizadas en decretos-leyes al calor del estado de alarma, que ha producido y producirá un amplio debate sobre su constitucionalidad, idoneidad jurídica y política y sobre el posible empleo de leyes ordinarias o de otros estados excepcionales de suspensión temporal de derechos derivados de alcance todo el territorio español y población española de su duración temporal y de sus consecuencias para la salud de los ciudadanos y para la económica general de España y de Canarias.

The main reason, because I choose this topic was, firstly, because it is a current topic, and secondly, because it has been for me a unique and historical event for mankind that I have to live, due to the impact that the arrival of this pandemic has had on the world population, both economically, healthy and socially. Once the topic was chosen, the methodology that I have followed in this development has been mainly based on opinion articles in the press and academic bibliography, as well as informing myself through the new son a daily basis. According to the conclusions obtained, I deduced that it will continue to be a matter of political, academic and citizen discussion, given the scope that it has had on our citizen rights and, on the discussions taking, formalized in Government decrees, during the emergency period, that has produced and will produce a broad debate on its constitutionality, legal and political stability and on the possible use or ordinary laws or other exceptional constitutional measures to suspend people’s rights derived from its scope. all the Spanish and population, of its temporary loans and its consequences for the health of the Spanish citizens and for the Spanish and the Canary Islands economy.
