La custodia compartida: análisis de la situación en tiempos de COVID-19

Abstract

En el presente trabajo se llevará a cabo un estudio del sistema de guarda y custodia compartida, algunas consideraciones generales con un enfoque teórico y legal, así como aquellos aspectos materiales y personales relacionados con dicho régimen. Dado que ese sistema se ha visto afectado por la declaración del Estado de Alarma a causa de la crisis sanitaria que ha originado el COVID-19, continuaremos con un análisis de este sistema durante dicha situación, ya que se ha producido una auténtica avalancha de dudas e incertidumbres entre los progenitores separados con hijos menores comunes, acerca del alcance y efectos de las restricciones a la libertad de movimientos de personas; planteándose qué sucede con su régimen de visitas o su régimen de guarda y custodia: ¿Si se suspende o sigue vigente? ¿Qué pueden hacer si un progenitor considera que sigue vigente y el otro progenitor no cumple con el régimen de visitas o de guarda y custodia? Es por todo ello, que el objetivo de este trabajo es arrojar luz sobre esas cuestiones que se han planteado, analizando y valorando las diferentes decisiones de jueces españoles ante un mismo problema, así como los motivos o razones que han dado lugar a esa disparidad de opiniones.

In the present work, a study of the shared custody system will be carried out, some general considerations with a theoretical and legal approach, as well as those material and personal aspects related to such regime. Given that this system has been affected by the declaration of the State of Alarm due to the health crisis caused by COVID-19, we will continue with an analysis of this system during sais situation, since there has been a real avalanche of doubts and uncertainties among separated of divorced parents with common minor children, about the scope and effects of the restrictions on the freedom of movement of people; wondering what happens to their visiting regime or their custody regime: If it is suspended or continues to be in force? What can they do if one parent belives that it is still in effect and the other parent doesn´t comply with the visitation or Custody arrangements? For all these reasons, the objective of this work is to shed light on these issues that have been raised, analysing and assessing the different decisions of Spanish judges faced with the same problema, as well as the reasons or grounds that have given rise this disparity of opinions.
