La igualdad electoral entre hombres y mujeres

La igualdad de voto entre mujeres y hombres se remonta al movimiento sufragista,
pudiéndose hacer un recorrido histórico desde su origen hasta la actualidad, pasando por la
Segunda República española y la conquista del derecho al voto para la mujer en la
Constitución Española de 1931. Tras la Constitución de 1978, se ha hecho necesaria la
aprobación de la disposición adicional segunda de la Ley Orgánica 3/2007, de 22 de marzo,
que reforma la Ley Orgánica 5/1985, de 19 de junio, del Régimen Electoral General, para
hacer efectiva la igualdad de mujeres y hombres, creando su artículo 44 bis, el cual consagra
el principio de composición equilibrada entre hombres y mujeres en las listas electorales.
Se realiza un seguimiento del proceso de adopción de cuotas electorales en España y
los efectos que ha supuesto su implantación con la Ley de igualdad a través del análisis
cuantitativo de las elecciones generales de 2008, así como de la jurisprudencia del Tribunal
Constitucional sobre su compatibilidad con el texto constitucional. The equality of vote between women and men dates back to the suffragist movement.
We are able to trace a historical journey from its origin to the present, going from the Second
Spanish Republic and the conquest of the right to vote for women in the Spanish Constitution
of 1931. After the Constitution of 1978, the approval of the second additional provision of
Organic Law 3/2007, of March 22, which reformed Organic Law 5/1985, of June 19, of the
General Electoral Regime, has been necessary to make equality between women and men
effective, creating article 44 bis, which enshrines the principle of balanced composition
between men and women in the electoral lists.
The process of adopting electoral quotas in Spain and the effects of its implementation
with the Equality Law is monitored through the quantitative analysis of the 2008 general
elections, as well as the jurisprudence of the Constitutional Court on its compatibility with
the constitutional text.
