Los bienes culturales de naturaleza mobiliaria. Estatuto jurídico.

Abstract

El presente trabajo se centra en el análisis de los bienes que conforman el patrimonio cultural español. El patrimonio cultural se compone de bienes culturales muebles e inmuebles, siendo los primeros, los que en mayor parte se someten al tráfico cultural. El traslado del patrimonio entre territorios puede incumplir los requisitos establecidos para que su transmisión sea lícita, por lo cual se prevén sanciones y mecanismos de recuperación por los distintos estados. España tiene sus propias herramientas para devolver el bien a su estado de origen, ya sea el propio estado español u otro, y también, a nivel europeo y extra europeo se establecen diversas formas para “regresar” los bienes que comprender el patrimonio cultural de un país. Pero la única obligación a nivel estatal, no termina con la defensa del patrimonio cultural, sino que se expande al deber de garantizar el acceso a la cultura, mientras que las Comunidades Autónomas contarán también con competencia para desarrollar otros aspectos relativos al patrimonio histórico español.

This paper focuses on the analysis of the assets that make up the Spanish cultural heritage. Cultural heritage is made up of movable and immovable cultural property, the former being those that are mostly subjected to cultural traffic. The transfer of heritage between territories may fail to comply with the requirements established for its transmission to be lawful, for which, sanctions and recovery mechanisms are provided for by the different states. Spain has its own tools for returning the property to its state of origin, whether it belongs to the Spanish state itself or another, and also, at European and extra-European level, various ways are established to “return” the assets that comprise the cultural heritage of a country. However, the only obligation on the state level does not end with the defense of the cultural heritage, but expands to a duty to ensure access to culture, while the Autonomous Communities will also have competence to develop other aspects of the Spanish historical heritage.
