El Tormento y la Ordalía: el uso del castigo físico como método para resolver controversias jurídicas penales

El objetivo de este trabajo es el análisis de las figuras del tormento y
del juicio de dios desde un punto de vista histórico, su origen,
desarrollo, el fin perseguido a través del uso de estos, es decir, la
confesión de la comisión del delito en el caso del tormento o,
simplemente dejar que fuera un órgano externo el que tomase la
decisión por ellos. Asimismo, se procederá al análisis de los actuales
derechos fundamentales a los que afecta y como se han protegido en la
legislación actual tanto nacional como internacional. Haciendo
referencia al derecho a la presunción de inocencia, así como al derecho de
no declarar contra sí mismo, al proceso legal con todas las garantías y el
derecho a la integridad física, estando prohibido completamente cualquier
tipo de menoscabo sobre la persona investigada por la presunta comisión de
un hecho delictivo. The objective of this essay is the analysis of the figures of torment and of
God's judgment from a historical point of view, their origin, development,
the end pursued through the use of these, that is, the confession of the
commission of the crime in the case of torture, or simply letting an external
body make the decision for them. Likewise, the current fundamental rights
affected and how they have been protected in current national and
international legislation will be analyzed. Referring to the right to the
presumption of innocence, as well as the right not to testify against himself,
the legal process with all the guarantees and the right to physical integrity,
being completely prohibited any type of impairment on the person
investigated by the alleged commission of a criminal act.
