El agente encubierto: especial referencia a la responsabilidad penal

Abstract

El crimen organizado es un tipo de delincuencia en auge. En España se estima que existen en torno a 500 grupos criminales según el Centro de Inteligencia contra el Terrorismo y el Crimen Organizado (CITCO). Ante esto, se presenta la figura del agente encubierto como un medio de investigación efectivo para combatir la mencionada delincuencia. El objeto de estudio de este trabajo será analizar los aspectos legales del agente encubierto, en concreto del desarrollo del artículo 282 bis de la LECrim, así como determinar la incidencia que produce esta herramienta de investigación en los derechos fundamentales de las personas investigadas. Además, se hará especial referencia al apartado quinto del artículo mencionado, relativo a la responsabilidad penal del policía por la realización de conductas típicas en el curso de la investigación.

Organised crime is a type of delinquency on the rise. In Spain, according to the Centre of Intelligence against Terrorism and Organised Crime (CITCO), it is estimated that there are around 500 criminal groups. In light of this, the figure of the undercover agent is presented as an effective means of investigation to combat the aforementioned crime. The object of study of this work will be to analyse the legal aspects of undercover agents, specifically the development of article 282 bis of the LECrim, as well as to determine the impact that this tool of investigation makes on the fundamental rights of the people investigated. Furthermore, special reference will be made to the fifth section of the above-mentioned article, relating to the criminal responsibility of the police officer for the realisation of typical conduct during the investigation.
