Investigación y experimentación con animales

Abstract

El objeto del presente trabajo es investigar y conocer el uso de los animales como seres experimentales y el daño, sufrimiento o perjuicio a los que se les puede someter. Como punto de partida comenzaremos con el estudio evolutivo histórico entre los que destacamos su origen en la etapa del Renacimiento. A continuación, para analizar esta problemática se presentan las diversas opiniones que se clasifican entre las que se encuentran a favor y las que están en contra del uso de los animales en el ámbito experimental. Posteriormente, se enuncia una monografía haciendo referencia al uso de anestesia en estos seres vivos y debido a la escasez normativa o al continuo cambio de las presentes leyes se expone la aplicación jurídica, la clasificación de estos animales en el Código Civil español, el marco normativo y la legislación aplicable entre las que destacamos las modificaciones hasta los actuales Reales Decreto 1386/2018, de 19 de noviembre y Real Decreto 53/2013. Finalizando el trabajo con la exposición de conclusiones extraídas de la información y datos estudiados.

This research is developed within the field of animal experimentation; understanding animal experimentation as the activity that focuses to highlight or clarify biological phenomena about certain animal species. The main characteristic of this experimentation stands out as the development of any procedure or activity in living beings, such as scientific experiments, including any action that may lead to produce any harm to the welfare state of the animal, or be liable to cause pain, anguish, suffering or grievance. In this document as an entry point, is found the historical research of this activity´s evolution , among which, is found the remarkable reappearance of animal experimentation during the Renaissance period. Therefore, to analyse this problem, the different approaches addressing this issue are compared, in addition to the legal application of it, being them essential. The multiple legal links among which are the regulations in the civil, criminal area are analyzed also. To continue, it´s necessary to emphasise the legal framework that nowadays includes this controversial and polemic subject. Furthermore, other remarkable sides analysed include the applicable legislation following this issue, including with it the different modifications made until the present Real Decreto 1386/2018 from the 19th of November and the Real Decreto 53/2013.In this previous mentioned legislations this important matter is regulated, November and the Real Decreto 53/2013.In this previous mentioned legislations this important matter is regulated, being a essential protection for the animal misuse in experimentation, scientific purposes, as well as the protection placement in favor of their animal care, transportation, exploiting, experimentation and sacrifice. Summarizing, this reseach covers the protection and safeguardestablished by our legal system concerning experimentation on susceptible living beings such as animals.
