Marco jurídico de los vertidos de aguas residuales en Canarias

Abstract

En este trabajo vamos a analizar la normativa aplicable en materia de vertidos de aguas residuales desde tierra al mar, partiendo del enfoque recogido en las normas de la Unión Europea, pasando a la legislación estatal vigente y haciendo una especial referencia a la distribución de competencias entre las diferentes Administraciones Públicas concurrentes. El objetivo es estudiar las principales características y requisitos aplicables a los puntos de vertido al mar localizados en la Comunidad Autónoma de Canarias y, más concretamente, en la isla de Tenerife. Finalmente, haremos un breve estudio de las infracciones administrativas y supuestos típicos penales en la materia.

In this paper we will analyze the applicable regulations on wastewater discharges from land to sea, based on the approach set out in the European Union standards, moving to the current state legislation and making a special reference to the distribution of skills between the different concurrent Public Administrations. The objective is to study the main characteristics and requirements applicable to the points of discharge to the sea located in the Autonomous Community of the Canary Islands and, more specifically, on the island of Tenerife. Finally, we will make a brief study of the administrative infractions and typical criminal cases in the matter.
