El estado de alarma en España en la pandemía de la COVID-19.

n this work we have analysed the states of exception included in article 116 of the Spanish
Constitution and developed on 1st June’s Organic Law 14/1981.
We have dealt with the states of alarm, exception and siege, making greater emphasis on the
state of alarm, since it has been the state decreed by the Spanish Government to give full
constitutional protection to the measures adopted to fight against the health pandemic,
known as COVID-19.
We have studied whether our fundamental rights have been suspended or, on the opposite,
limited, whether it was more of a disguised state of exception or a state of alarm.
We have also discussed the impact that this health crisis has had on our day to day, on
health service and on the economy.
Finally, we have focused on how this health crisis will be faced by the Autonomous
Communities after 9th May 2021. En el presente trabajo hemos analizado los estados de excepción recogidos en el artículo 116
CE y desarrollados en la Ley Orgánica 14/1981, de 1 de junio.
Hemos tratado los estados de alarma, excepción y sitio, haciendo un mayor hincapié en el
estado de alarma, ya que, ha sido el estado decretado por el Gobierno de España para dar
amparo constitucional pleno a las medidas adoptadas para combatir la pandemia sanitaria,
conocida como COVID-19.
Hemos analizado si se han suspendido o, por el contrario, se han limitado nuestros derechos
fundamentales, si se trataba más de un estado de excepción encubierto o de un estado de
alarma.
También hemos tratado el impacto que esta crisis sanitaria ha tenido en nuestro día a día, en
la sanidad y en la economía.
Para finalizar, nos hemos centrado en cómo se afrontará esta crisis sanitaria por parte de las
CCAA después del 9 de mayo de 2021.
