Nuevo Procedimiento Civil ante el fenómeno de la ocupación ilegal

Abstract

Este trabajo tiene por objeto mostrar la problemática actual de la ocupación ilegal y la ineficacia de los cauces procesales existentes para poner fin a dicho fenómeno. Se pretende hacer un análisis sobre el nuevo procedimiento introducido en la Ley 5/2019, de 11 de junio, que modifica la Ley de Enjuiciamiento Civil, en relación con las viviendas ocupadas. El legislador con esta actualización del antiguo interdicto de recobrar la posesión, ha otorgado protección a los poseedores legítimos, titulares de la propiedad o Administraciones públicas titulares de viviendas sociales ante el fenómeno actual de la ocupación ilegal, dotándoles de mecanismos que agilicen el proceso de desalojo y garantizar la inmediata recuperación del inmueble, evitando así que organizaciones mafiosas evadan la ley manteniéndose en dicha situación antijurídica.

The purpose of this work is to show the current problem of illegal occupation and how ineffective existing procedural channels are to put an end to this phenomenon. We intend to analyze the new procedure introduced in Law 5/2019, of June 11, which amends the Civil Procedure Law, in relation to squatted dwellings. With this update of the old injunction to regain possession, Legislators have granted protection to legitimate owners, property owners or public administrations that are holders of social housing in the face of the current phenomenon of illegal occupation, providing them with mechanisms that expedite the eviction process and guarantee the immediate recovery of the property, thus preventing mafia organizations from evading the law by remaining in this unlawful situation.
