dc.description.abstract | In this paper we address the study of the cases of atypicality in relation to the crime of drug trafficking, included in article 368 CP, where there is a lack of unanimity in both doctrine and jurisprudence regarding the legality of these cases, alluding to a series of requirements or guidelines that must be carried out within each of them to be declared as atypical. This problem is linked to the lack of harmfulness and, therefore, all conduct that does not harm the protected legal right, which is public health, is left outside the scope of this article. Specifically, we will study self-consumption, shared consumption, the sale of insignificant quantities, the invitation or donation to a specific subject and so-called compassionate deliveries. Special interest in the legality of cannabis social clubs, as this is an issue of particular importance at present, starting from the basis on which the creation of these clubs is based, a situation that lacks state regulation. | en |
dc.description.abstract | En el presente trabajo abordamos el estudio de los supuestos de atipicidad en torno al delito de tráfico de drogas, recogido en el artículo 368 CP, donde se produce una falta de unanimidad tanto en el aspecto doctrinal como jurisprudencial respecto a la legalidad de estos supuestos, aludiendo a una serie de requisitos o pautas que han de llevarse a cabo dentro de cada uno de ellos para declararse como atípicas. Este problema está vinculado a la falta de lesividad y, por tanto, se deja fuera del ámbito de este artículo todas aquellas conductas que no lesionan el bien jurídico protegido, siendo esta, la salud pública. En concreto, estudiaremos el autoconsumo, el consumo compartido, la venta de cantidades insignificantes, la invitación o donación a sujeto determinado y las llamadas entregas compasivas. Especial interés en la legalidad de los clubes sociales de cannabis, tratándose de un tema de especial importancia en la actualidad, partiendo de la base en la que se sustenta la creación de estas, situación la cual, carece de regulación estatal. | es |
