La violencia de género en el código penal.

2021Abstract
In this paper we address the criminal response to gender violence, this
problem acquires great relevance after the approval of LO 1/2004, of
December 28, on Comprehensive Protection Measures against Gender
Violence, which motivates the reform of the Code Criminal and introduces
specific criminal measures. However, all figures of gender violence
required the existence of an affective relationship for its application.
Subsequently, LO 1/2015, of March 30, which modifies Organic Law
10/1995, of November 23, of the Penal Code, provides a broader response
to gender violence by introducing gender without the requirement of the
previous existence of an affective relationship. Specific, gender is
introduced in the general part as one of the reasons for aggravating
discrimination in art. 22.4 CP, being able to apply this gender motivation in
the different criminal figures of the special part and also introduces other
crimes such as stalking, sexting, etc. in the special part, thus expanding the
field of application beyond the strictly affective.
Specifically, we address the study of the crime of injuries of art. 148.4 CP
and art. 153 CP, of the minor threats of art. 171.4 CP, of the slight
constraints of art. 172.2 CP, forced marriages of art. 172 (bis) CP,
persecutory harassment or stalking of art. 172 (ter) CP, the slight injuries or
vexations of art. 173.4 CP and the so-called sexting of art. 197.7 CP.
Finally, we will also raise other practical problems in the application of
these crimes, such as the requirement of domination or sexist element and
the possible violation of the non bis in idem, especially in relation to the
gender aggravation and the mixed aggravation. of kinship in those cases. in
which the circumstance is implicit in the specific criminal figure. En este trabajo abordamos la respuesta penal frente a la violencia de
género, este problema cobra gran relevancia a partir de la aprobación de la
LO 1/2004, de 28 de diciembre, de Medidas de Protección Integral contra la
Violencia de Género, que motiva la reforma del Código penal e introduce
figuras delictivas específicas de violencia de género, sin embargo, todas
ellas requerían para su aplicación la existencia de una relación afectiva.
Con posterioridad, la LO 1/2015, de 30 de marzo, por la que se modifica la
Ley Orgánica 10/1995, de 23 de noviembre, del Código Penal, da una
repuesta más amplia a la violencia de género al introducir el género sin la
exigencia de la existencia previa de una relación afectiva. En concreto, se
introduce el género en la parte general como uno de los motivos de la
agravante de discriminación del art. 22.4ª CP, pudiendo aplicarse esta
motivación de género en las diversas figuras delictivas de la parte especial
y también se introduce en la parte especial otros delitos como el stalking, el
sexting, etc., ampliando así el campo de aplicación más allá del
estrictamente afectivo.
Concretamente, abordamos el estudio del delito de lesiones del art. 148.4
CP y art. 153 CP, de las amenazas leves del art. 171.4 CP, de las coacciones
leves del art. 172.2 CP, los matrimonios forzosos del art. 172 (bis) CP, el
acoso persecutorio o stalking del art. 172 (ter) CP, las injurias o vejaciones
leves del art. 173.4 CP y el denominado sexting del art. 197.7 CP.
Por último, también plantearemos otros problemas prácticos en la
aplicación de estos delitos como la exigencia del elemento de dominación o
machista y la posible vulneración del non bis in idem sobre todo en relación
a la agravante de género y la agravante mixta de parentesco en aquellos
casos en que la circunstancia esté implícita en la concreta figura delictiva.
