Nociones básicas sobre bioderecho.

Abstract

The aim of this paper is to the question of what basic knowledge should a graduate in Law have about bio-law? Given the novelty of this discipline and its important relationship with the current reality, this paper addresses from the origin of bioethics to the concept and working methodology of biolaw, through the differentiation of this branch of law from other related institutions, to conclude with the most relevant biotechnological realities that biolaw must face, with special emphasis on embryonic research. All of this is based on European regulations, its jurisprudence and Spanish law. With the aim of bringing the jurist closer to the basic notions of biolaw.

El presente trabajo tiene como finalidad responder a la pregunta de ¿Qué conocimientos básicos debe tener un egresado jurídico en torno al Bioderecho? Dada la novedad de esta disciplina y su importante relación con la realidad actual, en este trabajo abordamos desde el origen de la bioética hasta el concepto y metodología de trabajo del bioderecho, pasando por la diferenciación de esta rama de otras instituciones análogas, hasta concluir con las realidades biotecnológicas más relevantes a las que debe hacer frente el bioderecho, con especial énfasis en la investigación embrionaria. Todo ello de la mano de la mano de la normativa europea, su jurisprudencia, y la ley española. A fin de acercar al jurista a las nociones básicas sobre el Bioderecho.
