Abstract

Due to the great impact that the internet has on people's daily lives, on the one hand, and the digital footprint they generate during their lives, on the other, it is necessary to study the so-called "digital inheritance". In this paper we will try to synthesise the recent Organic Law 3/2018, of 5 December, on Personal Data Protection and guarantee of digital rights, the pioneering regulation in our country of this subject in Catalonia, we will differentiate the concepts of virtual identity and digital identity and we will approach the concept of memoria defuncti and its legal protection. We will study what is referred to when talking about inheritance, its composition and the digital will. All of this through the study of the conditions that have been established in digital and communication platforms to respond to these questions that concern us more and more.

Debido al gran impacto que tiene internet en la vida diaria de las personas, por una parte, y la huella digital que generan durante su vida, por otra, se hace necesario el estudio de la denominada “herencia digital”. En este trabajo se tratará de sintetizar la reciente Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales, la regulación pionera en nuestro país de esta temática en Cataluña, diferenciaremos los conceptos de identidad virtual e identidad digital y nos aproximaremos al concepto de memoria defuncti y su protección legal. Estudiaremos a qué se hace referencia cuando se habla de la herencia, su composición y el testamento digital. Todo ello a través del estudio de las condiciones que se han establecido en las plataformas digitales y de comunicación para responder a estas cuestiones que nos preocupan cada vez más.
