Marco legal para la detección precoz y actuación enfermera ante violencia de género. Revisión sistemática.

2022Abstract
La mayoría de casos de violencia de género pueden detectarse a través de los servicios sanitarios. Esto se debe a que,
en muchas ocasiones, los malos tratos conllevan la necesidad de atención sanitaria. El personal sanitario, especialmente
las enfermeras, al ser el profesional de salud más accesible, se encuentra en una posición privilegiada para la detección
precoz de estas situaciones de maltrato. En el presente documento se revisa el concepto de violencia de género en
diferentes formas, cómo se estudia desde el punto de vista de la legislación y en los protocolos autonómicos de actuación
sanitaria. Se centrará especialmente en las actuaciones llevadas a cabo desde Atención Primaria de Salud dado que
recoge las características idóneas para su detección precoz, seguimiento y contacto directo con la población.
Objetivo: Revisión y comparación de la literatura científica, legislación, protocolos existentes, e instrumentos de cribado
y estudio de su validez y fiabilidad. Identificación de herramientas de detección precoz y el papel de Enfermería.
Metodología: Se trata de una revisión sistemática siguiendo el estándar PRISMA del marco legal sobre violencia de
género en España. Se revisan también los protocolos de actuación sanitaria ante violencia de género más actualizados
de las comunidades autónomas y del ministerio de sanidad obtenidos de las web de las consejerías o del observatorio
estatal de violencia sobre la mujer. Se evalúa la calidad de las guías con el instrumento AGREE. Se obtiene el grado de
recomendación de los instrumentos de cribado empleando el Índice GRAQoL.
Resultados: Se obtiene que, a nivel de legislación, las pautas de actuación son homogéneas. De los 18 protocolos
revisados, se obtiene que el de mejor calidad es el de Galicia. No todos los protocolos emplean cuestionarios
estandarizados, algunos utilizan una entrevista clínica. Los instrumentos de cribado tienen un grado A de recomendación.
Discusión: Las actuaciones sanitarias por parte de las comunidades, en materia de violencia de género, no deberían
diferir; existe la necesidad de emprender actuaciones encaminadas a la unificación de los criterios de actuación a nivel
regional en España. Sorprende que únicamente 7 protocolos de los 18 revisados empleen instrumentos de cribado.
Existen pocos cuestionarios validados en España, y de los existentes, es relevante que se empleen solo 4. Un reciente
estudio publicado por el Consejo Interterritorial, describe la necesidad de establecer una herramienta común para la
detección temprana de violencia de género en el sistema sanitario español. Las enfermeras son competentes para la
detección de malos tratos, sin embargo, esto supone un conflicto ético-legal.
Conclusiones: El enfoque, desde el punto de vista de los protocolos autonómicos difiere; no todas las guías ofrecen
cobertura de todos los niveles ni por parte de todos los profesionales implicados en la atención. Según la herramienta
empleada de evaluación de guías de práctica clínica, algunos protocolos son de mayor calidad que otros. La detección
precoz de violencia de género es una competencia incuestionable de las enfermeras. Most cases of gender violence can be detected through health services. This is because, on many occasions, it entails
the need for health care. Health care workers, especially nurses, being the most accessible ones, are in a privileged
position for the early detection of these situations of abuse. This document reviews the concept of gender violence in
different forms, how it is studied from the point of view of legislation and in the regional health action protocols. It will focus
especially on the actions carried out from Primary Health Care since it includes the ideal characteristics for early detection,
monitoring and direct contact with the population.
Objectives: Review and comparison of the scientific literature, legislation, existing protocols, and screening instruments
and study of their validity and reliability. Identification of early detection tools and the role of Nursing.
Method: This is a systematic review following the PRISMA standard of the legal framework on gender violence in Spain.
The most up-to-date protocols for health action against gender-based violence of the autonomous communities and the
Ministry of Health obtained from the websites of the ministries or the state observatory of violence against women are also
reviewed. The quality of the guidelines is evaluated with the AGREE instrument. The degree of recommendation of the
screening instruments is obtained using the GRAQoL Index.
Results: From the legal framework point of view, the action guidelines are similar. Out of the 18 protocols reviewed,
Galicia`s one has the best quality. Not all protocols use questionnaires for diagnosis, some just use a simple clinical
interview. The screening instruments have a high recommendation.
Discussion: The health actions by the communities, in terms of gender violence, should not differ; There is a need to
undertake actions aimed at the unification of action criteria at a regional level in Spain. It is surprising that only 7 protocols
of the 18 reviewed use screening instruments. There are few validated questionnaires in Spain, and of those that exist, it
is relevant that only 4 are used. A recent study published by the Interterritorial Council describes the need to establish a
common tool for the early detection of gender-based violence in the Spanish health system. Nurses are competent to
detect abuse, however, this implies an ethical-legal conflict.
Conclusions: The approach varies from the point of view of the different regional protocols; Not all guides offer coverage
at all levels nor by all professionals involved in care. According to the clinical practice guideline assessment tool used,
some protocols have higher quality than others. The early detection of gender violence is an unquestionable competence
of nurses.
