El teletrabajo: prevención y riesgos.

Abstract

The new information and communication technologies have produced the appearance and implementation of the teleworking modality, and its rise due to the Covid-19 health crisis. In the study of this work we will talk about its new current regulations, the prevention of occupational harzards, damages, risks and certain occupation accidents to which the worker is exposed to at home. During the study of the text, we will answer questions such as, Do teleworkers have the same rights in occupational risk prevention as workers who carry out their activity preesentially? Which are the areas or limits of the dwelling that must comply with the occupational risk prevention requirements? What preventive measures can the employer take? Will the employer and the worker have disciplinary responsibilities if they do not comply with their obligations in terms of occupational risk prevention? Could there be an accident in itinere in teleworking mode?

Las nuevas tecnologías de la información y comunicación han producido la aparición y implantación de la modalidad del teletrabajo, y su auge debido a la crisis sanitaria de la Covid-19. En el estudio de este trabajo hablaremos de su nueva normativa vigente, la prevención de riesgos laborales, daños, riesgos y ciertos accidentes laborales a los que esta expuesto el trabajador en el domicilio. A medida que avancemos en el estudio del texto daremos respuesta a cuestiones tales como, ¿Los teletrabajadores tienen los mismos derechos en prevención de riesgos laborales que los trabajadores que realizan su actividad en modalidad presencial? ¿Zonas o limite de la vivienda que debe cumplir con los requisitos de prevención de riesgos laborales? ¿Qué medidas preventivas podrá adoptar el empresario? ¿El empresario y el trabajador tendrán responsabilidades disciplinarias si no cumplen con sus obligaciones en materia de prevención de riesgos laborales? ¿Cabría accidente in itinere en modalidad de teletrabajo?
