dc.description.abstract | This paper examines the Western Sahara conflict by exposing and analysing the United Nations resolutions that grant the Sahrawi people their right to self-determination and to constitute themselves as an independent state. Firstly, a brief historical context is provided, showing Spain's colonisation of the entire territory. It also discusses the agreements between Spain and Morocco on the region. Next, the concept of terra nullius is discussed, which does not allow Spain to acquire sovereignty over the territory through occupation, since an organised people already existed beforehand, whose right to self-determination will be recognised by the United Nations. Furthermore, the constitution and legitimacy of the Sahrawi Arab Republic will be analysed. Having seen the rights of the Saharawi people, the positions of both the United Nations and the African Union will be presented, as well as the inability to find a solution to this conflict due to Morocco's persistence in not complying with the Settlement Plan or the Baker Plan. Finally, Morocco, due to its refusal to comply with international law, will make an Autonomy Proposal in 2007, which greatly benefits its claims to the area at the expense of the right of all Saharawis to live freely. In conclusion, the responsibilities that Spain still has in the region as an administering power will be mentioned. | en |
dc.description.abstract | Este trabajo estudia el conflicto del Sáhara Occidental exponiendo y analizando las resoluciones de las Naciones Unidas que le otorgan al pueblo saharaui su derecho a la autodeterminación y a constituirse como un Estado Independiente. En primer lugar, se muestra un breve contexto histórico que expone la colonización por parte de España en todo el territorio. Así como, los acuerdos entre España y Marruecos sobre la región. Seguidamente, se aborda el concepto de terra nullius que no le permite a España adquirir la soberanía del territorio mediante la ocupación, puesto que previamente ya existía un pueblo organizado al que se le reconocerá por las Naciones Unidas su derecho a la libre autodeterminación. Además, se analiza la constitución y la legitimidad de la República Árabe Saharaui. Una vez visto los derechos que le corresponde al pueblo saharaui, se expone las posturas tanto de las Naciones Unidas como de la Unión Africana, así como de la incapacidad de dar una solución a este conflicto debido a la persistencia de Marruecos de no cumplir el Plan de Arreglo, ni el Plan Baker. Para finalizar, Marruecos y debido a su negativa de cumplir con el Derecho Internacional, hace una Propuesta de Autonomía en el año 2007, que beneficia enormemente sus pretensiones sobre la zona a costa del derecho de todos los saharauis a vivir libremente. Además, se mencionan las responsabilidades que tiene todavía España en la región como Potencia Administradora. | es |
