Estudio doctrinal y jurisprudencial de la prisión permanente revisable

Abstract

Esta investigación realiza un completo estudio sobre la prisión permanente revisable, comenzando por sus antecedentes históricos y exponiendo después su actual configuración en el ordenamiento jurídico-penal español. Incluye también un análisis de la jurisprudencia relacionada con la misma, ordenado comenzando por las sentencias más importantes para resumir analíticamente después las más recientes por la manera en que afectan a esta pena. A través de un profundo examen de Derecho penal comparado, se incluye una valoración de esta figura en las leyes de países como Alemania o Reino Unido, y se comparan con la normativa española. Por último, y utilizando una sentencia fundamental en este caso procedente del Tribunal Constitucional español, concluye la investigación con un análisis de la constitucionalidad de esta controvertida figura jurídica que es la prisión permanente revisable. This research carries out a complete study on revisable permanent imprisonment, beginning with its historical background and then setting out its current configuration in the Spanish legalpenal system. It also includes an analysis of the related jurisprudence, starting with the most important judgments and then summarising analytically the most recent ones in terms of how they affect this penalty. Through a deep examination of comparative criminal law, an assessment of this figure in the laws of countries such as Germany and the United Kingdom is included, and they are compared with the Spanish one. Finally, and using a fundamental ruling in this case from the Spanish Constitutional Court, the research concludes with an analysis of the constitutionality of this controversial legal figure: the revisable permanent imprisonment.
