dc.description.abstract | En este trabajo se analiza el tratamiento legislativo dispensado a los principales elementos del Impuesto sobre Renta de las Personas Físicas desde una perspectiva de familia, y las reformas tras la entrada en vigor de la nueva ley reguladora del impuesto. La relevancia del tema a tratar deriva en que las circunstancias familiares del obligado tributario modulan la carga impositiva del mencionado impuesto, mediante deducciones en la cuota o reducciones en la base imponible, y por ello, el legislador excluye de tributación a aquella parte de la base liquidable conocida como el “mínimo personal y familiar”. Este mínimo familiar dependerá, entre otros, de que el contribuyente tenga descendientes o ascendientes a su cargo, o de que estos presenten alguna discapacidad, siempre que cumplan una serie de requisitos. A lo largo del trabajo, se hace hincapié en el requisito de la convivencia para la aplicación del mínimo por descendientes y ascendientes, a causa de la transcendencia del fallo de una sentencia del Tribunal Constitucional resolviendo esta cuestión. | es_ES |
dc.description.abstract | This report analyzes the legislative treatment of the main elements of the Personal Income Tax from a family perspective, and the reforms after the entry into force of the new law regulating the tax. The relevance of the subject to be dealt with derives from the fact that the family circumstances of the taxpayer modulate the tax burden of the aforementioned tax, by means of deductions in the quota or reductions in the taxable base, and for this reason, the legislator excludes from taxation that part of the taxable base known as the "personal and family minimum". This family minimum will depend, among others, on whether the taxpayer has dependent descendants or ascendants, or if they have a disability, provided that they meet a series of requirements. Throughout the report, emphasis is placed on the requirement of cohabitation for the application of the minimum for descendants and ascendants, due to the transcendence of the ruling of the Constitutional Court resolving this issue | es_ES |
