El reto de la imposición sobre la economía digital: deficiencias de la regulación actual del impuesto sobre determinados servicios digitales

2022Abstract
El presente trabajo pretende analizar el estado actual de la imposición sobre determinados
servicios digitales, como aproximación al gravamen de las empresas digitales. Desde el Plan
BEPS ha existido una voluntad latente de los estados y organizaciones internacionales por
adaptar el sistema de tributación societaria tradicional al nuevo modelo de mercado digital.
Como primer paso, los estados han establecido sus propios impuestos sobre servicios digitales
a la espera del desarrollo de un acuerdo multilateral que permita afrontar la tributación de
la economía digital de forma conjunta. La implementación de este acuerdo se pronostica
para fechas no muy lejanas, mas, entretanto, en el contexto actual sobreviven los impuestos
unilaterales. En el caso de España, la regulación del impuesto sobre determinados servicios
digitales plantea dudas en torno a sus elementos configuradores y naturaleza que requieren
ser despejadas para su mejora en caso de que el desarrollo del acuerdo multilateral se retrase.
A tal finalidad se destinan las páginas que siguen, centrando el objeto de este estudio en el
examen de los puntos débiles de la regulación vigente. This article aims to analyze the current state of taxation on certain digital services as an
approach to the taxation of digital companies. Since the BEPS Plan, there has been a latent
willingness of States and International Organizations to adapt the traditional corporate tax-
ation system to the new digital market model. As a first step, States have enacted their own
taxes on digital services until the final proposal for an agreement that would allow them to
jointly address the taxation of the digital economy is made available. The development of
these agreements is expected in the not too distant future, but in the meantime, unilateral
taxes survive in the current context. In the case of Spain, the Tax on Certain Digital Ser-
vices raises certain reflections on its essential elements that need to be discussed in order
to improve them in the event that the multilateral agreement doesn’t arrive in due course.
