Evolución del suelo rústico en la legislación urbanística

Abstract

The present project aims to understand the regulation of current rustic land, both state and regional, through an through extensive research of the evolution of urban planning legislation in Spain and, more specifically, in the Autonomous region of the Canary Islands. Therefore, a study is carried out from scratch, starting with the State Law of April 9th, 1864, until the current Law 7/2015, as well as the autonomic Law 5/1987, until the recent Law 4/2017. Also, at the end of the work, there is a section dedicated to the legislative measures adopted by the eruption of the volcano on the island of La Palma, since much of the land affected by it was categorized as rustic land.

El presente trabajo tiene como finalidad comprender la regulación del suelo rústico actual, tanto estatal como autonómico, mediante una exhaustiva investigación de la evolución de la legislación urbanística en España y, más concretamente, en la Comunidad Autónoma de Canarias. Por lo tanto, se realiza un estudio desde cero, comenzando con la Ley estatal de 9 de abril de 1956, hasta la actual Ley 7/2015, así como la Ley autonómica 5/1987, hasta la reciente Ley 4/2017. Asimismo, al final del trabajo, se le dedica epígrafe a las medidas legislativas adoptadas por la erupción del volcán de la isla de La Palma, puesto que gran parte del terreno afectado por el mismo estaba categorizado como suelo rústico.
