El crédito horario

Abstract

Los representantes de los trabajadores tienen conferidas una serie de garantías para el ejercicio de sus funciones representativas en el ámbito de la empresa, dichas garantías tienen como objetivo facilitar el ejercicio de la actividad sindical, sin injerencias por parte de la empresa, y se encuentran protegidas constitucionalmente, dentro de esta garantías, nos encontramos con el crédito horario, supone una facultad conferida a cada representante para poder realizar su actividad sindical bajo la protección de un permiso retribuido con un límite mensual de horas. Esta figura no ha estado exenta de polémica al no haber habido un desarrollo reglamentario y la litigiosidad en tribunales ha sido alta, por ello, en este trabajo, trataremos de forma breve cada aspecto de esta institución y como los tribunales han venido modulando su uso y disfrute.

The worker's representatives are granted a series of guarantees for the exercise of their representative functions within the company. Said guarantees are intended to facilitate the exercise of union activity, without interference by the company, and are protected constitutionally, within these guarantees, we find the hourly credit, it supposes a power conferred on each representative to be able to carry out their union activity under the protection of a paid leave with a monthly limit of hours. This figure has not been exempt from controversy as there has been no regulatory development and litigation in courts has been high, therefore, in this paper, we will briefly discuss each aspect of this institution and how the courts have been modulating its use and enjoyment
