Responsabilidad civil y el uso de la inteligencia artificial en el marco legislativo de la Unión Europea.: consumidores y usuarios.

Abstract

The main interest of this Final Degree Project is to delve into the civil liability for the use of artificial intelligence. The giant leaps in new technologies and robot science make it necessary for the law to start taking action to contribute to their safe implementation and development. In the absence of specific and clear national regulations on the subject, we will start with the analysis of the new legislative framework pushed by the European Union. A proposal aimed at reducing risks, increasing security and protecting the fundamental rights of European citizens. This is complemented by a guaranteeing regulation for victims based, in particular, on civil liability in case of risk materialization due to the use of artificial intelligence. All this will directly affect consumers and users, a point that we will highlight in the development of the work, through small practical examples. Beyond emphasizing the importance of an effective regulation on artificial intelligence, both national and European, this work aims to elaborate a guide on the European regulations in this regard. The multitude of regulations, their vagueness and fragmentation, and their dispersion within the normative framework make the search for the jurist a real worry. In addition, this special task of legal classification and research will facilitate the reader's practice and will serve as an index for an in-depth analysis of the topics addressed.

El presente Trabajo de Fin de Grado tiene como principal interés ahondar en la responsabilidad civil por el uso de la inteligencia artificial. El avance a pasos agigantados de las nuevas tecnologías y la robótica, hacen necesario que el derecho comience a tomar acción para contribuir a su implementación segura y desarrollo. En defecto de una normativa interna, especifica y clara sobre la materia partiremos, para ello, del análisis del nuevo marco legislativo impulsado por la Unión Europea. Una propuesta destinada a reducir los riegos, aumentar la seguridad y proteger los derechos fundamentales de los ciudadanos comunitarios. Que se complementa con una normativa garantista para las víctimas basada, sobre todo, en la responsabilidad civil ante la materialización del riesgo por uso de inteligencia artificial. Todo ello afectará de forma directa a los consumidores y usuario, punto que pondremos en valor en el desarrollo del trabajo, a través de pequeños ejemplos prácticos. Más allá de enfatizar en la importancia de una regulación eficaz en materia de inteligencia artificial, tanto interna como europea, este trabajo persigue como objetivo la elaboración de una guía orientativa sobre la normativa europea al respecto. La pluralidad de normas, su falta de claridad y concreción y su dispersión dentro del marco normativo hacen que la búsqueda del jurista se convierta en una verdadera preocupación. En adición, esta especial labor de clasificación e investigación jurídica facilitará la tarea del lector y servirá de índice para un análisis en profundidad sobre los temas abordados.
