Derechos fundamentales de acceso a la seguridad social

Abstract

This work reflects the figure of the protective action of social security regulated in the General Law of Social Security, Spanish constitution, and other laws, related regulations. Beginning with a historical analysis of the figure of work and the causes of the emergence of protection against contingencies, up to our current legislation. To then move on to a more exhaustive analysis of the figure itself, its elements, as well as the extensions and limitations made by the law itself, highlighting the presumption of employment. Social security also acts as a protective action in the social protection rights of foreign workers who reside and work in a country other than their country of origin. Finally, a very current topic is reflected, such as the impact of COVID-19 on Social Security and its action against it.

Este trabajo plasma la figura de la acción protectora de la seguridad social regulado en la Ley General de Seguridad Social, constitución española, y otras leyes, normativas afines. Comenzando por un análisis histórico de la figura del trabajo y las causas del surgimiento de la protección frente a las contingencias, hasta llegar a nuestra actual legislación. Para luego pasar a un análisis más exhaustivo de la propia figura, de sus elementos, así como de las ampliaciones y limitaciones que hace la propia ley, destacando la presunción de laboralidad. También la seguridad social actúa como acción protectora en los derechos de protección social de los trabajadores extranjeros que residen y trabajan en un país distinto al de origen. Finalmente se plasma un tema muy actual, como es repercusión del COVID- 19 en la Seguridad Social y su actuación frente a ella.
