La nueva realidad penal del maltrato animal: la clarificación del bien jurídico y objeto material.

Abstract

The objective of this paper is to analyze the developments proposed by the criminal reform of LO 3/2023, of 28 March, in the area of animal abuse. The reform of the legal status of animals in the civil sphere was a first step towards updating the normative considerations towards animals and with the modifications in the configuration of the figure of abuse it is possible to observe a new step forward in the animal protection. On the one hand, it will investigate the opposition of the new article 340 bis regarding its antecedents in the Criminal Code, both as a crime and a misdemeanour, and then proceed to consider the modifications on the penalty, the establishment of a new legal right as a closure to the doctrinal discussion that was being developed in this regard, as well as the inclusion of the term "vertebrate animal" in reference to the material object of the crime, and the consequences that they display.

El presente trabajo tiene como objetivo el análisis de las novedades planteadas por la reforma penal de la LO 3/2023, de 28 de marzo, en materia de maltrato animal. La reforma del estatus jurídico de los animales en el ámbito civil fue un primer paso para la actualización de las consideraciones normativas hacia los animales y con las modificaciones en la configuración de la figura del maltrato es posible observar un nuevo paso adelante en la protección animal. Por un lado, se va a indagar en la contraposición del nuevo artículo 340 bis con respecto a sus antecedentes en el CP, tanto como delito como falta, para posteriormente pasar a examinar las modificaciones sobre la penalidad, el establecimiento de un nuevo bien jurídico como cierre a la discusión doctrinal que se venía desarrollando al respecto, así como la inclusión del término “animal vertebrado” en referencia al objeto material del delito, y las consecuencias que despliegan
