El derecho de los menores a la libertad religiosa en el ordenamiento Español

Abstract

Son muchos los derechos que asisten a los menores de edad. En el presente trabajo, estudiaremos la libertad religiosa de éstos, tomando en consideración la influencia de la objeción de conciencia y la patria potestad. A pesar de ser titulares de este derecho fundamental, sus padres también ostentan el poder de decidir sobre su formación religiosa, surgiendo así, conflictos en el ámbito familiar. Con la intención de beneficiar al menor y proteger en todo momento sus derechos y sentimientos religiosos, serán objeto de estudio las distintas alternativas establecidas en la legislación de nuestro país, tomando como punto de partida, la Constitución Española. Una vez analizadas las leyes en las que se reconocen los derechos fundamentales de los menores, veremos distintas sentencias en las que se dan estas situaciones. Con el propósito de obtener un mayor conocimiento sobre la libertad religiosa del menor, el trabajo finalizará con las conclusiones a las que se han llegado después de estudiar sus aspectos más relevantes.

Minors have many rights. In the this project, we will study their religious freedom, taking into consideration the influence of conscientious objection and parental authority. Despite being holders of this fundamental right, their parents also have the power to make decisions on their religious education, generating conflicts in the family environment. With the intention of benefiting the minors and protecting their rights and religious feelings at all times, we will study the different alternatives established in the legislation of our country, being the Spanish Constitution our starting point. Once we have analyzed the laws that recognize the rights of minors, we will learn about different sentences in which these situations occur. With the purpose of obtaining a better knowledge about the religious freedom of the minor, the work will end with the different conclusions that have been reached after studying its most relevant aspects.
