The aim of this project is to study some protection measures for victims of domestic and genderbased violence, as well as the effectiveness of these measures in practice, but not before highlighting
the need for a legal distinction between both types of violence in order to avoid the same legal
treatment of problems that are different. To this end, different doctrinal opinions will be considered,
analysing the passive subjects of domestic violence and gender violence and the essential elements
that must be present in order to speak of one type of violence or the other.
With regard to protection measures for victims of domestic and gender-based violence, the subject
of this study, possible alternatives proposed by the doctrine that resolve the deficiency of some
procedural aspects related to these measures will be pointed out
El objetivo de este proyecto es estudiar algunas medidas de protección para las víctimas de violencia
doméstica y de género, así como la eficacia de dichas medidas en la práctica, no sin antes poner de
manifiesto la necesidad de una distinción jurídica entre ambos tipos de violencia para evitar el mismo
tratamiento jurídico a problemas que son diferentes. Para ello, se atenderá a diferentes opiniones
doctrinales analizando los sujetos pasivos de la violencia doméstica y de la violencia de género y qué
elementos esenciales tienen que concurrir para hablar de un tipo de violencia u otro.
En lo que respecta a las medidas de protección para las víctimas de violencia doméstica y de género,
objeto de este estudio, se señalarán posibles alternativas propuestas por la doctrina que resuelvan la
deficiencia de algunos aspectos procesales relacionados con dichas medidas.
