El derecho Internacional ante la violencia contra la mujer.

Abstract

Violence against women and girls is a latent problem in our society, both nationally and internationally. It is for this reason that this paper will study and analyse the concept of "violence against women" from the point of view of International Law, with special reference to “sexual violence”, as well as the subjects involved in it. We will then look at the normative evolution of international law, with emphasis on some legislative texts of marked legal relevance. This is the case of the Declaration on the Elimination of violence against women of December 20, 1993 or Instanbul Convention. In the following sections, the aim will be to determine the response of the European Court of Human Rights to violence against women, pointing out important sentences, as well as the position of the International Criminal Court. Finally, the need to introduce a binding international text on the matter at hand is specified, as well as new provisions to regulate the current situation

La violencia contra las mujeres y niñas es un problema latente en nuestra sociedad, tanto en el plano nacional como internacional. Es por ello que a través del presente trabajo, se procede a estudiar y analizar, desde el punto de vista del Derecho Internacional el concepto de “violencia contra la mujer”, con especial referencia a “la violencia sexual”, así como los sujetos implicados en la misma. Seguidamente, se observará la evolución normativa en el plano internacional haciendo hincapié en algunos textos legislativos de marcada relevancia jurídica. Siendo el caso de la Declaración sobre la eliminación de la violencia contra la mujer de 20 de diciembre de 1993 o el Convenio de Estambul. En los siguientes apartados, se buscará determinar la respuesta del Tribunal Europeo de Derechos Humanos ante la violencia contra la mujer, señalando importantes sentencias, así como también la posición de la Corte Penal Internacional. Finalmente, se precisará la necesidad de introducir un texto internacional vinculante en la materia que nos ocupa, al igual que nuevas disposiciones que regulen la actual situación.
