La renovación del Consejo General del Poder Judicial y del Tribunal Constitucional en España: problemática actual.

Abstract

A día de hoy, y con respecto al poder judicial, nos encontramos con una situación realmente problemática: El Consejo General del Poder Judicial –es decir, el órgano de gobierno de los jueces y regulador del poder judicial– se encuentra en funciones prorrogadas desde 2018 debido a una falta de acuerdo para su renovación, derivando en una tardía renovación del Tribunal Constitucional y del Tribunal Supremo. En el presente estudio nos centraremos en analizar la problemática existente en la actualidad con respecto a la composición y renovación del Consejo General del Poder Judicial y el Tribunal Constitucional, analizando las recomendaciones que han realizado distintas instituciones europeas y expertos en la materia, para así proponer algunas mejoras al sistema actual, en aras de evitar una situación en el futuro como en la que nos encontramos hoy en día.

As of today, and regarding the judiciary power, we find ourselves in a problematic situation: The General Council of the Judiciary –that is, the governing body of judges and regulator of the judiciary power– has been in extended functions since 2018 due to a lack of agreement for its renewal, resulting in a late renovation of the Constitutional Court and the Supreme Court. Therefore, in this study, we will focus on analyzing the current problems related to the composition and renewal of the General Council of the Judiciary and the Constitutional Court, analyzing the different recommendations made by various European institutions and experts in the field, to propose some improvements to the current system, in order to prevent a situation in the future like the one we find ourselves in today.
