El retracto de créditos litigiosos. Alternativas a su ejercicio.

Abstract

Throughout this work we will study the figure of the withdrawal of litgious credit, present in article 1535 of the Civil Code. We Will carry out a presentation and analysis of the elements that make up this figure, developing the most important concepts in this regard. We will present the requirements that are required to be able to carry out its exercise correctly and the debates, both doctrinal and jurisprudential, that they have been causing, making known the current jurisprudential position and the alternatives that have been trying to arise regarding to cases of non-aplication. We will now go on the present the options available to the debtor who does not see it possible to exercise this right in order to be able to pay his debt or, as far as possible, achieve a reduction in its impact. Within these possibilities we will present the negotiation with the new creditor or the possibility of taking advantage of the second opportunity.

A lo largo del presente trabajo estudiaremos la figura del retracto de crédito litigioso, presente en el artículo 1535 del Código Civil. Realizaremos una presentación y análisis de los elementos que componen esta figura, desarrollando los conceptos más importantes al respecto en esta materia. Presentaremos los requisitos que se exigen para poder llevar a cabo su ejercicio de forma correcta y los debates, tanto doctrinales como jurisprudenciales, que los mismos han ido provocando, dando a conocer la postura jurisprudencial actual y las alternativas que han ido tratando de darse en cuanto a los supuestos de no aplicación. Pasaremos a continuación a presentar las opciones de las que dispone el deudor que no ve posible el ejercicio de este derecho para poder hacer frente al pago de su deuda o, dentro de lo posible, conseguir una disminución en cuanto a su impacto. Dentro de estas posibilidades presentaremos la negociación con el nuevo acreedor o la posibilidad de acogerse a la segunda oportunidad.
