The present work examines the attribution of the use of the family home in family
crises, with a special focus on joint custody and the protection of the best interests
of the child. It analyzes the conceptualization of the family and the family home
from a legal and doctrinal perspective and studies the current legal regime, including
the evolution of the right of use and the protection of minors. The topic is addressed
through an analysis of the jurisprudence of the Supreme Court and provincial courts,
identifying solutions such as the temporary assignment of the home and the rotating
use through the "nest" house system. Consensual agreements and cases of loss of
the status of the family home are also considered. The objective is to provide a
comprehensive understanding of the criteria and jurisprudential trends in this area,
ensuring a fair resolution for the parents, which, in turn, guarantees the protection
of the children. El presente trabajo examina la atribución del uso de la vivienda familiar en crisis
familiares, con especial enfoque en la custodia compartida y la protección del interés
superior del menor. Se analiza la conceptualización de la familia y la vivienda
familiar desde una perspectiva legal y doctrinal, y se estudia el régimen legal
vigente, incluyendo la evolución del derecho de uso y la tutela del menor. Se aborda
el tema del trabajo mediante un análisis de la jurisprudencia del Tribunal Supremo
y las audiencias provinciales, identificando soluciones como la asignación temporal
de la vivienda y el uso rotativo mediante el sistema de casa nido. También se
consideran los acuerdos consensuados y los casos de pérdida de condición de
vivienda familiar. El objetivo es proporcionar una comprensión integral de los
criterios y tendencias jurisprudenciales en este ámbito, asegurando una resolución
justa para los progenitores que garantice a su vez, la protección de los menores.
