Viviendas vacacionales en Canarias: legislación actual y proyección hacia un urbanismo sostenible

Abstract

Este trabajo tiene por objeto el análisis jurídico de la vivienda vacacional y su evolución desde la etapa preconstitucional hasta la actualidad y su relación con el Derecho Urbanístico. Asimismo, se estudiarán las consecuencias jurídicas relativas al aumento de las viviendas vacacionales y las competencias urbanísticas municipales como título de intervención al alojamiento turístico en Canarias. Además, se analizarán las particularidades de la vivienda vacacional en las islas de El Hierro, La Palma y La Gomera, así como el Anteproyecto de Ley de Ordenación Sostenible del Uso Turístico de Viviendas y los objetivos de esta norma para lograr un modelo turístico sostenible con el patrimonio, el medioambiente y la sociedad canaria. Por último, se ha realizado un estudio comparado respecto la normativa sobre esta materia en otras Comunidades Autónomas.

This work aims at the legal analysis of holiday housing and its evolution from the preconstitutional stage to the present, as well as its relationship with urban planning law. It will also study the legal consequences related to the increase of holiday homes and municipal town planning powers as a title of intervention to tourist accommodation in the Canary Islands. In addition, it will analyze the peculiarities of holiday accommodation in the islands of El Hierro, La Palma and La Gomera, as well as the Preliminary Bill for the future holiday accommodation regime in search of a sustainable tourism model with heritage, environment and Canary society. Finally, a comparative study has been carried out about other Autonomous Communities and their regulation on the subject
