La transposición del derecho de la Unión Europea por las comunidades autónomas

Abstract

Este artículo estudia la problemática existente en torno a la transposición del Derecho europeo por las CCAA. Cuando éstas no transponen, lo hacen fuera de plazo o de forma defectuosa, el responsable ante las Instituciones europeas es únicamente el Estado, siendo sancionado en caso de incumplimiento. Para evitarlo, y garantizar la aplicación del Derecho europeo, el Estado ha buscado una serie de cauces. En este documento se analizan dichos cauces, concluyendo que son insuficientes y aportando vías alternativas para resolver el problema.

This article studies the existing problems concerning the transposition of the European Union Law by the Autonomous Communities. When these do not transpose, take place outside the time period or are done by defect, the State will be the only responsible entity facing the European institutions, being penalized in the case of infringement. To avoid this and to guarantee that the European Law is applied, the State has looked for a series of alternative ways. This paper analyzed these ways, concluding that these are insufficient and providing alternatives to solve the problem.
